Fan-Creator Contract

Introduction: This Fan-Creator Contract sets out the standard terms governing every interaction and transaction between a Fan (subscriber/user) and a Creator on the Fantra platform. By subscribing to or purchasing content from a Creator on Fantra, the Fan and the Creator each agree to the following terms. These terms are incorporated into and enforceable via Fantra’s Terms of Use. Fantra is not a party to individual Fan-Creator agreements; instead, Fantra acts as a facilitator. All Fan-Creator transactions are contracts between the Fan and the Creator only, subject to these terms and platform rules. Fantra provides the platform and payment systems but is not responsible for the performance or non-performance of either party under this contract.

Definitions

For clarity, here are key definitions related to this document.

• Fan means a user who purchases access to a Creator’s content on the Service

• Creator means a user who offers content on the Service for a fee

• Content means the creative works available through the Service

• Licence means a limited personal right for a Fan to access content via their account

• Custom Content means content created to a Fan’s request subject to platform rules

• No Unauthorised Use means no downloading, copying, or redistribution outside the Service without permission

• Acceptable Conduct means respectful behaviour that follows platform rules during any interaction

• Off Platform Arrangements means exchanges outside the Service, which are not permitted

1. Content Access and Licence

• Access Rights: Upon a Fan’s successful subscription or payment for a Creator’s content, the Creator grants the Fan a limited, non-transferable licence to access and view the purchased content through the Fantra platform. This licence is for personal, non-commercial use only and lasts for the duration of the subscription or as otherwise expressly provided (for one-off purchases or time-limited content access).

• No Unauthorised Use: Fans must not download, screenshot, screen-record, copy, redistribute, or repost any Creator content outside the Fantra platform unless the Creator gives explicit written permission through the platform. All content is owned by the Creator (or licensed to the Creator), and nothing in this contract transfers ownership. The Fan’s rights are limited to viewing content via their own account. Any attempt to circumvent digital rights management, remove watermarks, or share content without authorisation is a breach of this contract.

• Creator Obligations: The Creator must make the paid-for content accessible to the Fan through the platform upon payment. For a subscription, this generally means the Fan can view all eligible content the Creator posts during the subscription period (and, if applicable, past content as per the Creator’s content settings). For individual purchases (such as a paid message, custom AI-generated piece, or one-time content pack), the Creator will deliver or enable access to the content within a reasonable time after payment (or as otherwise described at purchase). Creators have sole discretion over the content they offer and its pricing, but once a Fan has paid, the Creator must not unreasonably remove or withhold access to that content. If a Creator fails to provide the paid content or access, the Fan may lodge a complaint under Fantra’s Complaints Policy, and the Creator may be in breach of this contract and the platform’s Terms of Use.

• Fictional Content Notice: All content on Fantra is fictional, adult-oriented content generated by AI under the Creator’s direction. No real people appear in any content. The Fan acknowledges that any characters or scenarios depicted are entirely fictional and over 18 years of age. Any similarity to real persons, living or dead, is coincidental. The Fan agrees to treat the content as fantasy entertainment only, and not to attempt to misuse it (for example, the Fan must not claim it depicts real individuals or attempt to identify any real person from it).

2. Acceptable Conduct and Content Standards

This section outlines behaviour expectations and content boundaries for both Fans and Creators during their interactions on Fantra. Both parties agree to use the platform respectfully and lawfully at all times:

• Mutual Respect: Fans and Creators will treat each other with respect and courtesy. Harassment, hate speech, stalking, extortion, or any form of abusive behaviour is strictly prohibited. Fans must not attempt to coerce or pressure Creators into engaging in activities or content they are uncomfortable with or that violate the rules. Creators must likewise not harass or exploit Fans. Communication between Fans and Creators (such as comments or private messages) should remain civil and appropriate. Either party can report abusive behaviour through the platform’s reporting tools or contact support as per the Complaints Policy.

• No Off-Platform Arrangements: For the safety and privacy of both parties, Fans and Creators should keep their interactions on the Fantra platform. Exchanging personal contact information (such as phone numbers, email addresses, social media handles) or soliciting in-person meetups is discouraged and may be restricted for safety compliance. Fantra does not moderate off-platform communications, so staying on-platform ensures both parties are protected by Fantra’s policies and moderation.

• Content Boundaries (Prohibited Content): Both Fans and Creators are strictly forbidden from requesting, producing, or sharing any content that violates Fantra’s content standards or the law. This includes, without limitation:

  • Minors: Absolutely no content depicting or purporting to depict minors (under 18 years old) in any scenario, sexually explicit or otherwise. Fans must not request, and Creators must not create, any material featuring characters who are or appear to be minors. Violation of this rule will result in immediate account termination and referral to law enforcement.

  • Real Persons and Non-Consensual Depictions: No “deepfakes” or content that represents real individuals without consent. All erotic content must involve fictional characters. Using the likeness of any real person (whether a public figure or private individual) in an explicit context is prohibited unless that person is verified and has given explicit consent through Fantra’s processes (note: currently Fantra is an AI-only content platform with no real-person performers). Additionally, rape, sexual violence, or any non-consensual acts (even in fictional form) are disallowed. Consensual BDSM or fantasy roleplay content must be clearly consensual in context.

  • Illegal or Extreme Content: No content that includes bestiality (sexual content involving animals), necrophilia, actual incest (fictional “step-family” roleplay scenarios must comply with legal guidelines and age of all characters must be 18+), sexual torture or extreme violence, or any other content that would be considered obscene or illegal under applicable laws. Content glorifying real-world sexual violence, trafficking, or exploitation is banned.

  • Child Sexual Abuse Material (CSAM): Any hint or attempt to create CSAM (even AI-generated) will result in immediate banning and report to authorities. Fantra’s AI is designed to block any depiction of minors, and users must not try to circumvent this.

  • Other Unlawful Activities: No use of the platform for escorting/prostitution arrangements, human trafficking, or soliciting sexual services. Fantra is not a dating or escort service; it is a content subscription platform. Any proposal by a Fan to pay a Creator for sexual services outside the scope of digital content is forbidden and will be reported. Likewise, Creators must not solicit Fans for money outside the platform or involve them in fraud or scams.

• Platform Moderation: Creators are responsible for ensuring all content they create, and share complies with these standards. Fantra employs moderation (which may include a combination of AI filters and human review) to enforce content rules. If a Fan discovers content that violates these rules, they should report it immediately. Creators understand that Fantra may remove or restrict content that breaches guidelines and may suspend or terminate creators who produce prohibited material. Fans also acknowledge that if they request or persistently seek disallowed content, they are subject to suspension or banning.

• Fan Content (Interactions): Fans may be allowed to post comments or send messages to Creators. Any user-generated text or content from Fans must also follow the above standards (no illegal proposals, no personal data of minors, no harassment, etc.). Creators have the right to moderate or block a Fan from interacting with them if the Fan violates rules (in addition to any platform-level enforcement).

• Confidentiality: Fans and Creators should respect each other’s privacy. Private messages, custom content, or personal stories shared through the platform should not be exposed publicly by the other party. Creators should not divulge personal information about their Fans, and Fans must not “dox” (expose personal information about) Creators. This also means a Fan must not threaten to reveal a Creator’s identity (if known) or a Creator share a Fan’s identity. Fantra expects all parties to uphold confidentiality and privacy in line with our Privacy Policy.

3. Payments, Subscription Terms and Refunds

• Pricing and Transactions: Creators are solely responsible for setting the prices for their subscription tiers, content packages, or any custom content offers. All prices will be clearly displayed in the platform’s interface in Australian dollars (AUD) or other supported currencies, inclusive of any platform fees or taxes as applicable (if not included, taxes will be added at checkout where required by law). By initiating a purchase or subscription, the Fan agrees to pay the advertised price. Fantra’s payment processor will charge the Fan’s provided payment method at the point of purchase (for one-off content or tips) or on a recurring basis for subscriptions (e.g. monthly). A Fan must have a valid payment method on file to enter into a Fan-Creator transaction. Fantra facilitates the payment and will display a confirmation once the transaction is successful, at which point the Fan-Creator contract for that content is formed.

• Revenue Share: The Fan’s payment is processed by Fantra, which then credits the Creator with the appropriate earnings after deducting any platform fees, payment processing fees, or taxes. Creators are responsible for any taxes on their earnings as required by their local laws. This section is a notice to both parties: Fans pay Fantra, and Fantra pays Creators; a Fan’s obligation is fulfilled by paying the platform, and the Creator’s obligation is to provide the content. Fans are not required to send any payments to Creators outside the platform and should never arrange to pay a Creator off-platform (doing so violates Fantra’s Terms and voids any protections; Fantra is not responsible for any off-platform payments).

• No Circumvention: Fans and Creators agree not to attempt to circumvent the platform’s payment system. A Creator should not solicit direct payments from a Fan outside Fantra for content, and Fans should not offer it. All Fan-Creator financial transactions for content must go through Fantra. This ensures compliance, security, and entitlement to dispute resolution under this contract. If any user is found attempting to bypass the platform for payments, Fantra may take action including account termination and/or legal steps.

• Refund Policy: All sales and subscriptions on Fantra are final. Given the nature of digital content access, Fantra operates a no-refunds policy on Fan-Creator transactions except where required by law or explicitly stated otherwise. Once a Fan has subscribed to a Creator or purchased content, they gain immediate access to valuable digital material; as such, refunds are generally not provided if a Fan simply changes their mind or was dissatisfied with the content. However, if a technical issue on the platform’s side prevents the Fan from accessing the content they paid for, or if the Creator fails to deliver promised custom content, the Fan should contact Fantra Support (see Complaints Policy) for assistance. We may, at our discretion, provide remedies in certain cases (such as restoring access or crediting the Fan’s account) in line with consumer protection laws. Creators acknowledge that Fantra may reverse a transaction or issue a refund to a Fan if a Creator has materially failed to provide the paid content or if payment was fraudulent or made in error.

• Chargebacks and Fraudulent Disputes: Fans agree not to initiate chargebacks or payment reversals with their bank/credit card for valid transactions. If a Fan believes a charge is incorrect or unauthorised, they should notify Fantra Support immediately to investigate. Initiating a chargeback without first contacting us is considered a breach of this contract. Unjustified chargebacks (for example, claiming a charge was unauthorised or product not delivered when in fact it was) may result in the Fan’s account being suspended or terminated. Fantra investigates chargeback claims; if a Fan’s chargeback is successful, Fantra reserves the right to recoup the funds from the Creator’s earnings if the Creator had already been paid for that transaction. Likewise, Creators must not abuse the dispute process — providing the promised content in a timely manner and according to description will avoid disputes. Fantra will cooperate with payment providers in investigating fraud. Repeated or egregious payment disputes from a Fan may lead to that Fan being banned from the platform.

• Subscription Renewals and Cancellations: If a Fan subscribes to a Creator on a recurring basis, the subscription will automatically renew at the end of each billing cycle (e.g. monthly) unless the Fan cancels. Fans are responsible for managing their subscriptions via their account settings. If a Fan cancels a subscription, they will retain access to the Creator’s paid content until the end of the period already paid for, after which access ends. No prorated refunds are given for cancelling mid-subscription; cancellation simply stops the next auto-renewal. Creators must not intentionally delete or paywall previously available content in a way that defeats a Fan’s paid access during an active subscription term. If a Creator leaves the platform or is terminated by Fantra, active subscriptions will be cancelled and Fans will not be charged further; any consideration for partial refunds in such cases will be handled by Fantra on a case-by-case basis (for example, if a Creator is removed for policy violations, we may issue credits to Fans who just recently subscribed).

• Tips and One-Time Payments: Fans may have the option to send one-time tips or payments to Creators (for example, to request a custom AI-generated scenario or just to show appreciation). Such tips are entirely voluntary. If a tip is given in exchange for a specific promised content (like a custom render or scenario), the Creator should endeavour to deliver that content as agreed. If they fail to do so, the Fan can report this to Fantra. Pure tips given without expectation of content are non-refundable. Creators acknowledge that soliciting large tips for off-platform promises or any inappropriate purpose is against policy.

4. Disclaimers and Liability

• Fictional Content Disclaimer: The Fan and Creator both acknowledge that all content on Fantra is simulated and fictional. No actual sexual activity is performed or recorded; everything is an AI-generated production for entertainment. Creators craft scenarios and images with the aid of AI, but these do not involve real people. Fans understand that the content may be explicit and fantastical. Viewer discretion is advised. Fantra and Creators do not endorse any activity depicted in fantasy content as appropriate in real life. By consuming or creating content on Fantra, both parties agree that they are engaging with fantasy material. If a Fan finds any content disturbing or triggering, they should cease viewing and may unsubscribe; neither Creators nor Fantra are liable for a Fan’s personal emotional or psychological response, provided the content adheres to the stated guidelines and laws.

• No Professional Advice: Any content on Fantra (including any erotic stories, roleplay, chat or “advice” a Creator might give in-character) is not to be construed as professional advice (legal, medical, psychological, etc.). Fans should not rely on any information provided by Creators in content or messages as factual or advisory. It is provided for adult entertainment only.

• Fantra’s Role and Liability: Fantra’s Terms of Use contain broader disclaimers, but in context of Fan-Creator interactions: Fantra is an intermediary platform that enables Fans and Creators to connect. Fantra does not guarantee continuous availability of any particular Creator or content. While we strive to enforce rules and maintain a safe environment, Fantra is not liable for the actions of Fans or Creators towards each other beyond what is required by law. Any contract or exchange of content is between those parties. For example, Fantra is not responsible if a Creator fails to upload as frequently as a Fan hoped, or if a Fan says something rude to a Creator (though we will take enforcement action if notified of harassment). However, Fantra will reasonably enforce this Contract and its policies when aware of violations. We also do not guarantee that content will meet a Fan’s personal expectations in terms of fantasy scenario or quality, as tastes are subjective.

• Third-Party Rights: Creators must ensure that their content does not infringe any third-party intellectual property rights or privacy rights. Fans must similarly not introduce any material in requests or messages that would cause infringement. Both parties agree that if any third-party claims arise from content or interactions (for example, a person alleging a Creator used their likeness, or someone claiming defamation from a scenario), the party responsible for the content or comment in question will bear responsibility. Fantra may remove the content and will comply with lawful orders, but the Creator indemnifies Fantra for liabilities arising from the Creator’s content, and likewise, the Fan indemnifies Fantra for liabilities arising from the Fan’s conduct. (See Terms of Use for the full indemnification clause and limitation of liability.)

• No Warranty: To the fullest extent allowed by law, Fantra provides its platform and services “as is” without warranties. This Fan-Creator Contract imposes duties on Fans and Creators to each other, but it should be understood that Creators do not guarantee a Fan’s satisfaction, and Fans do not guarantee continuing patronage. Both parties accept the risk that content may be removed if it violates policies, or accounts may be closed if terms are broken. Fantra is not liable for any loss of prospective earnings by a Creator or loss of expected entertainment by a Fan due to enforcement of this Contract (for instance, if Fantra must terminate a Creator for policy breaches, Fans will lose access to that Creator’s content).

5. Breach and Enforcement

• Reporting Breaches: If a Fan or Creator believes the other party has violated this Contract (or any platform policy), they should report it to Fantra via the Complaints Policy process or the in-app reporting functions. For example, if a Fan is pressuring a Creator to make banned content, the Creator should report the Fan. If a Creator is sharing content beyond agreed terms or engaging in prohibited conduct, the Fan should report the Creator. Fantra will review reports impartially.

• Investigation and Action: Fantra may investigate alleged breaches. This can include reviewing communication logs, content in question, and other relevant data in line with our Privacy Policy. Both Fans and Creators must cooperate with any investigation (e.g. providing clarifications if asked). If we determine a breach occurred, actions may include content removal, warning notices, temporary suspension of the offending user, or permanent account termination in serious cases. Fantra strives for a fair outcome – minor first-time infractions might get a warning, while egregious violations (such as uploading illegal content or engaging in harassment) will result in swift termination and possible referral to law enforcement.

• Termination of Contract: This Fan-Creator Contract is automatically terminated between a particular Fan and Creator if either’s account is deactivated or banned, or if the Fan’s subscription to that Creator ends and no other active transaction remains between them. However, even after termination, both parties remain bound to honour clauses that by their nature survive termination – such as non-disclosure of private content, intellectual property rights, and disclaimers of liability. A Fan who has downloaded or retained any content (if that was permitted) must cease use of it upon contract termination (unless express lifetime licence was granted, which is unusual on this platform). Fantra may also terminate the Fan-Creator relationship by banning the interaction (for instance, if required by law or a protective measure).

• No Waiver: If a Fan or Creator breaches this Contract and the other party or Fantra does not immediately enforce a remedy, it does not mean the right to enforce is waived. For example, if a Creator overlooks a Fan sharing a piece of content outside initially and doesn’t report it, that doesn’t stop the Creator (or Fantra) from acting on a subsequent breach.

• Governing Law: This Fan-Creator Contract is governed by the same governing law and jurisdiction as set out in Fantra’s Terms of Use (noting that Fantra is based in Australia, but the platform may specify a governing law for all contracts). Both Fans and Creators agree to resolve any disputes arising from this Contract in accordance with the dispute resolution terms in the Terms of Use.

• Severability: If any provision of this Contract is found to be unlawful or unenforceable, the remainder of the Contract remains in effect. The invalid provision will be deemed modified to the narrowest extent necessary to make it valid, or if that’s not possible, severed, without affecting the validity of the rest of the Contract.
